Terms of Service

These Terms of Service govern your access to and use of CurbKit. Please read them carefully. By creating an account or using the Service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using CurbKit ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.
2. Description of Service
CurbKit is an AI-powered marketing platform for real estate professionals. The Service generates property listing copy (MLS descriptions, social media posts, emails, and more), enhances listing photos, and surfaces property data to help agents market properties more effectively.
3. Account Registration
To access most features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must be at least 18 years old and have the legal authority to enter into these Terms. Notify us immediately at support@curbkit.app if you suspect unauthorized use of your account.
4. Subscriptions & Billing
CurbKit offers subscription plans billed monthly. By subscribing, you authorize us to charge your payment method on a recurring basis at the applicable plan rate. All fees are in US dollars and are non-refundable except as required by law. We may change pricing with 30 days' notice. You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period, after which you retain access until that period expires.
5. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose or in violation of any applicable regulations; (b) submit false, misleading, or discriminatory property information; (c) scrape, reverse-engineer, or attempt to extract source code from the Service; (d) use the Service to generate content that violates fair housing laws, constitutes fraud, or infringes any third-party rights; or (e) share your account credentials with others. We reserve the right to suspend accounts that violate these restrictions.
6. AI-Generated Content
The Service uses large language models (Claude by Anthropic) to generate marketing copy. AI-generated content is provided as a starting point and may contain inaccuracies, omissions, or errors. You are solely responsible for reviewing, editing, and approving all content before publishing or submitting it to any MLS or platform. CurbKit makes no warranty that generated content complies with any specific MLS rules, state licensing requirements, or fair housing regulations. Always review content with professional judgment.
7. Property Data
The Service may retrieve and display property data from third-party sources (including Zillow via Apify). This data is provided for informational purposes only and may be incomplete, outdated, or inaccurate. CurbKit does not guarantee the accuracy of any third-party property data. Do not rely on this data as the sole basis for pricing or marketing decisions.
8. Intellectual Property
CurbKit and its licensors retain all rights to the Service, including its underlying technology, design, and content. You retain ownership of the property data, photos, and agent notes you submit. You grant CurbKit a limited license to process your content solely to operate and improve the Service. The AI-generated output (listing copy, etc.) is yours to use freely once generated, subject to these Terms.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in the Privacy Policy.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CURBKIT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURBKIT AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE FEES YOU PAID TO CURBKIT IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may close your account at any time by contacting support@curbkit.app. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice in the Service at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Miami-Dade County, Florida.
